Part 2 of a 3 part series

Tenant Filing Against Landlord

In my last blog I told you how a landlord filed. This blog will tell you how a tenant can file. As with this entire series, this is not legal advice; simply, it’s an overview of what happens at magistrate court.

A tenant filing against a landlord is typically because of the condition of the unit or repairs that re not being made by the owner. Most times, the tenant will simply say “I’m not going to pay the rent” but, this is not a deciding factor with the Pocono magistrates. What you must do is notify the landlord in writing of the problem and give them a reasonable amount of time to correct the problem. Often it’s no heat, poor water source or another repair that’s more than just a minor problem but something that interferes with the quiet enjoyment of the unit that the tenant occupies.

If the landlord does not comply with making the repair or communicate back to the tenant with regard to the status of the repair, then the tenant should notify the owner one last time that they are (1) holding back rent in lieu of the repair not being done or (2) giving them one last chance to fix it and if not completed within ” X ” amount of time, that further action will be taken against them.

Money can then be held in escrow: Note: it is highly suggested that you either use a management company, such as NEPA Management Associates or you can do it yourself by opening up an account and depositing money equal to the rent in that account. Hold the rent money with instructions not to release it to the landlord or, you simply need to have that money reserved in some way, shape or form.

Don’t just not pay the rent and then spend the money. You should keep it somewhere in safe keeping until such time as the court makes the decision as to who is to get the money and what the outcome of the trial is.

You as tenant then file at magistrate court just as an owner or landlord would. You’ll find Pocono magistrates very much in your corner if you follow the rules.

As I stated in the beginning, this is an overview as to what happens in the Pocono Mountains which is where I am most familiar with the magisterial courts and representing tenants and owners in this specific area. It is not legal advice and it should only be looked at as an overview as to what happens and nothing more than that.

Dominick J Sacci President

Stroudsburg – Better Homes and Gardens Real Estate Wilkins & Associates announced Dominick J. Sacci, Senior Vice President/General Manager has been promoted to the position of President. The promotion was part of a presentation held by Better Homes and Gardens Real Estate at the popular destination, Desaki in Swiftwater on August 12th. The entire Wilkins organization attended in addition to the Honorable Mario Scavello, Robert Uguccioni, retired PMVB Exec Director, Beverly Hay, PMAR Assoc Exec and Robert Albanese, V.P. Strategic Services with Better Homes and Gardens Real Estate LLC.

Sacci started with Wilkins over 16 years ago in the position of PA Salesperson. He took the required courses and passed the required State examination to become an Associate Broker. After that, he was responsible first for opening the Wind Gap office in 2001 and then the Easton office in 2002, which was an acquisition of Greentree Real Estate. Sacci since that time has been involved, along with Thomas R. Wilkins, CEO, in a number of acquisitions and roll-in transactions.

Said Thomas R. Wilkins, CEO, “To have Dominick at the helm makes me feel very confident that we will be able to ride out the current real estate market, prepare for the re-growth of the company with our new model and continue to be the driving force we’ve been for so many years in Pocono real estate for a long time to come.”

Sacci, originally from New Jersey, grew up in Mt. Pocono where he resided for 20+ years. Sacci was home-schooled and is currently pursuing an Associates Degree in Business Management from Northampton Community College.

Sacci resides in Effort with his wife Sylwia and their 2 year-old son Sebastian.

Stroudsburg – Better Homes and Gardens Real Estate Wilkins & Associates announced the hiring of 15 sales recruits for their real estate company. Each of the individuals is either registered to take the required real estate courses online or the required real estate courses at the Pocono Real Estate Academy while others are ready to take their PA real estate exam.

Michael Poalillo, Realtor joined the company through the coaching of the Wilkins & Associates Recruiter and is now a licensed Realtor with the company. “Wilkins & Associates helped me get my real estate license by pitching in and supporting me while taking the two courses. I then just recently passed the real estate exam and am now ready to start my new career.” said Poalillo. Poalillo, prior to joining the Wilkins organization, was involved in the investment real estate business. He was sponsored by Better Homes and Gardens Real Estate Wilkins & Associates.

Darlene Haese joined the Wilkins organization and is taking the Better Homes and Gardens Real Estate “free” in-houses courses. Haese is a licensed PA Salesperson.

Tyeace Brown has taken all the required RE courses, passed the PA real estate exam and is waiting for her Salesperson license to come from Harrisburg. Brown will begin her Better Homes and Gardens Real Estate in-house courses.

Camille Lamberson has just completed her real estate courses at the Pocono Real Estate Academy and is scheduled to take the PA real estate exam. Lamberson will also begin her in-house courses.

The Wilkins organization has 11 persons enrolled in the required real estate courses to obtain a PA Salesperson license and are on their way to changing their careers. Ken Beharry, Al Grant, Jesse Rambo, and Richard Holmes are currently enrolled at the Pocono Real Estate Academy and taking the required RE courses. They expect to graduate in the coming months.

Theresa Olsen, Kirk Olsen, Daniel Ortiz, Roy Deans, Chris Van Zilen, Jay Nucero and Timothy Schmon are currently enrolled in online courses and expect to graduate within the next several weeks.
